Preliminary Work

All work carried out by Showcase Creative Ltd before and after pricing is agreed is chargeable at the discretion of Showcase Creative Ltd.

Copy

Showcase Creative Ltd reserves the right to make changes to the cost and timescales of the project where additional work must be carried out as a result of unclear client copy.

Pricing

All pricing is subject to sight of artwork. Unless specified in writing, print-ready files, set up correctly to our templates and artwork guidelines, are to be supplied by the customer. A hand holding charge may be applied to resolve any errors in artwork that is not supplied correctly. Please refer to our artwork guidelines for more information.

PDF Proofs

PDF proofs are supplied for all jobs. Showcase Creative Ltd can proceed no further without sign off in writing of a PDF proof. A PDF proof is to be used to check and sign off artwork for print including but not exclusive to layout, copy and trim/crease marks. Showcase Creative Ltd shall incur no liability for any errors not corrected by the customer in PDF proofs submitted. Additional charges shall be made for any additional amends that are required as a result of alterations required by the customer once a PDF proof has been signed off.

Printed Proofs

Printed proofs are supplied at the customer’s request and are subject to Showcase Creative Ltd’s standard pricing. A printed proof is to be used to check that colours are correct. Showcase Creative Ltd shall incur no liability for any errors not corrected by the customer in printed proofs submitted. Showcase Creative Ltd shall incur no liability for any unexpected results in colour should a printed proof not be signed off. Additional charges shall be made for any additional printed proofs that are required as a result of alterations required by the customer.

Sign-Off

Sign-off for printed proof and payment in full is required before Showcase Creative Ltd can proceed with the customers printed proof (unless otherwise stated in the invoice). Sign-off for print and payment in full is required before Showcase Creative Ltd can proceed to print. Showcase Creative Ltd cannot accept responsibility for any unexpected results should the customer proceed without a printed proof.

Payment and Invoicing

Showcase Creative Ltd cannot commence printing until payment is received in full and funds have cleared (unless otherwise agreed and stated on the invoice). The customer may not amend the information contained in the invoice once it has been paid. Showcase Creative Ltd reserves the right to amend pricing and turnaround subject to customer’s changes, including changes requested by the customer, once an invoice has been paid.

Colour Printing

If colour matching is necessary, hard copy samples of the required colour must be sent by the customer in order to gain accuracy. Colours on screen may vary greatly from printed material. Significant changes in colour can also occur between the printed proof and the final printed documents when lamination is applied. To gain a true representation of colour at the hard copy proofing stage it is highly recommended that the customer request a laminated proof, (however this may incur an additional charge for the lamination set-up). Showcase Creative Ltd will not be held responsible for any issues (e.g. peeling) with laminated products where the combined CMYK ink coverage is greater than 100%. (Showcase Creative Ltd can assist in checking of artwork.) Showcase Creative Ltd does not guarantee an exact match in colour and texture between any materials supplied by the customer and the finished article.

Delivery

Dispatch date will be calculated from the first full working day following the date of sign-off for print. Turnaround is measured in Working Days, defined as days on which the clearing banks in the City of London are open for normal business. Dispatch for all unlaminated, digitally printed products is up to 5 full working days from payment (and clearance of funds) and for laminated, digitally printed products is up to 7 working days unless otherwise specified in the invoice. Standard turnaround times, as well as jobs that include an ‘Express Service’ are based on a date for dispatch. If a late delivery is the result of the action or inaction of a third party, such as a carrier, Showcase Creative Ltd will in no event be liable to the customer or any person or entity claiming through the customer for any direct, indirect, consequential, incidental loss or any other damages.

Liability

Showcase Creative Ltd gives no warranties or guarantees or makes any representations as to the merchantability or fitness for a particular purpose of any completed work the subject of a customer’s order and all other warranties, conditions, guarantees or representations, whether express or implied, oral or in writing, except as expressly stated in these terms and conditions are hereby excluded. Showcase Creative Ltd shall not be liable for any loss arising from delay in transit not caused by Showcase Creative Ltd. Further, Showcase Creative Ltd shall not be liable for any indirect, special or consequential damages, loss of profits, economic loss, loss of goodwill or loss of anticipated savings or loss of data. The total aggregate liability of Showcase Creative Ltd in respect of any and all causes of action arising out of or in connection with the customer’s order and Showcase Creative Ltd’s performance of services pursuant to such order (whether for breach of contract, strict liability, tort (including, without limitation, negligence), misrepresentation or otherwise) shall be limited to the sums paid to Showcase Creative Ltd by the customer in respect of the order pursuant to which liability has arisen. Nothing in these terms and conditions shall be construed so as to limit or exclude liability which cannot, pursuant to English Law, be excluded or limited including for death or personal injury or liability in respect of fraud or fraudulent misrepresentation.

Variations in Quantity

Every effort is made by Showcase Creative Ltd to deliver the correct quantity ordered. However, reasonable minor variations are understood for which Showcase Creative Ltd accept no liability. No credit will be awarded for shortages of up to 10% of the complete order up to 1000 units and up to 5% on quantities over 1000.

Variations in Price

Showcase Creative Ltd reserves the right to amend pricing at any time after pricing has been agreed on products and services in order to accommodate for any fluctuation in costs.

Tax

Showcase Creative Ltd reserves the right to charge any VAT or Tax on products where agreed or otherwise.

Credit terms and Payment

Showcase Creative Ltd reserves the right to charge 2% interest over the HSBC base rate at the time and an administration fee for any invoices not settled within the agreed credit terms.

Force Majeure

Showcase Creative Ltd shall be under no liability if it shall be unable to perform any obligation which is owed by it to the customer for any reason beyond his control including (without limiting the foregoing) Act of God, legislation, war, fire, flood, drought, failure of power supply, lock-out, strike or other action taken by employees in contemplation or furtherance of a dispute or owing to any inability to procure materials required for the performance of the contract.

Variation to Terms and Conditions
